1. About these terms

These Terms and Conditions (“Terms”) govern access to and use of the Flygrow Africa web dashboard, field applications, APIs and related services (the “Platform”) operated by Flygrow Africa (“Flygrow”, “we”, “us”). By creating an account, signing in, or using the Platform, you agree to these Terms on behalf of yourself and, where applicable, the cooperative, company, county or institution you represent.

2. Who may use the Platform

Access is limited to authorised users: Flygrow staff, contracted field agents and pilots, cooperative and institutional partners, and farmers or farmer representatives invited by an authorised partner. You must provide accurate registration details and keep login credentials confidential. You are responsible for activity under your account.

3. Services we provide

Flygrow provides precision agriculture operations support (including drone spraying and spreading coordination), farm digital records (“Digital Twins”), agronomic and weather-related advisory tools, soil sensor views, scoring and portfolio reports for partners, and related software features. Features may change as we improve the Platform. Some modules are pilots and may use estimated or modelled data (including yield estimates and weather forecasts from third parties such as Open-Meteo).

4. Not professional advice

Farm Scores, yield predictions, spray-window indicators, NDVI views, sensor interpretations and SMS or in-app advisories are decision-support tools only. They are not a substitute for independent agronomic, legal, financial or insurance advice. Always confirm critical field actions with qualified personnel and local conditions. Flygrow does not guarantee yields, pest outcomes, credit decisions or weather accuracy.

5. Farmer and partner data

You and your organisation remain responsible for obtaining any consents required to upload farmer contact details, farm boundaries, photos, operation logs and related data. We process personal data to operate the Platform, deliver services, improve models, meet legal obligations and, where agreed, share limited portfolio indicators with authorised financial or county partners. Do not upload data you are not entitled to share. Detailed privacy practices may be described in a separate privacy notice.

6. Acceptable use

You must not misuse the Platform: attempt unauthorised access, disrupt services, reverse engineer except as allowed by law, use the Platform for unlawful activity, or scrape or resell data without written permission. Field operations must comply with Kenyan law, pesticide regulations and aviation/drone rules.

7. Intellectual property

The Platform, branding, software, models and documentation are owned by Flygrow or its licensors. You receive a limited, non-exclusive right to use the Platform for your internal agricultural and partnership purposes while your subscription or pilot agreement remains active.

8. Third-party services

Maps, satellite or weather layers, messaging and payment providers may be supplied by third parties (for example Mapbox, Open-Meteo, SMS gateways). Their availability and terms may affect related features. Ground weather stations remain our preferred system of record where installed; forecasts are complementary.

9. Limitation of liability

To the fullest extent permitted by applicable law, Flygrow is not liable for indirect, incidental or consequential losses, including lost harvests, profits or data, arising from use of the Platform or reliance on scores, maps, advisories or forecasts. Our total liability for claims relating to the Platform in any twelve-month period is limited to fees paid to Flygrow for the Platform in that period (or a modest fixed amount for free pilots, as stated in your agreement).

10. Suspension and termination

We may suspend or terminate access for breach of these Terms, non-payment, legal risk, or end of a pilot. You may stop using the Platform at any time. Provisions that by nature should survive (including IP, liability limits and data clauses) continue after termination.

11. Governing law

These Terms are governed by the laws of Kenya. Disputes should first be raised in good faith with Flygrow; unresolved disputes may be submitted to the courts of Kenya, unless your written partnership agreement specifies another process.
